Terms and conditions of the rental contract

 
1Article 1 Object of the contract:
  • The rental of a cycle with its basic equipment by VéloTour Saguenay, hereinafter referred to as "the lessor"
Article 2 Equipment for cycles:
  • All the bicycles rented have basic equipment consisting of the following accessories: Lock, basket or passenger kit + helmet
Article 3 Effective date, provision and recovery:
  • The rental takes effect when the tenant takes possession of the equipment and accessories delivered to him. The risks will be transferred when the equipment and accessories are handed over to the lessee who will assume custody of them under his full responsibility, the latter agreeing to use them in all circumstances "as a good citizen"
  • This contract is only in effect for the duration of the rental. If the tenant keeps the equipment beyond this period without having regularized his situation, he loses the benefit of all the guarantees provided for in the contract and will have to pay the rental costs in addition.
  • The tenant acknowledges having received the rented item in good working order with the basic equipment
  • He declares that he was personally free to check the equipment and to choose it in accordance with his needs.
Article 4 Payment and payment methods for the service:
  • The entire service must be paid by the lessee before taking possession of the equipment, online or at the time of the provision of the equipment covered by this contract.
  • The accepted payment methods are: Cash, bank cards, credit cards or bank transfer.
 
Article 5 Use:
  • The tenant certifies that he is able to use the rented equipment that he undertakes to use himself.
  • By express agreement between the parties, the loan or subletting of equipment is strictly prohibited.
  • By express agreement between the parties, it is strictly forbidden for the lessee to intervene on the equipment in the event of a breakdown without the agreement of the lessor, the lessee must notify the lessor's breakdown service.
  • The tenant agrees to use the chosen rental with caution, without danger to third parties in accordance with the regulations in force.
  • Wearing a helmet is compulsory by the rental company in Quebec.
  • When parking the equipment, it is mandatory for the tenant to install the anti-theft device.
  • In the event of theft of equipment, the tenant must immediately notify the lessor, file the complaint with the competent authorities and provide a photocopy of the complaint.

Article 6 Liability for breakage - theft:
  • The tenant does not benefit from any cover for the damage suffered by the chosen one rented and engages personally his responsibility for the aforementioned damage, breakage and theft,
  • However, the tenant can not be held responsible for the damaging consequences of hidden defects of the rented equipment or non-apparent wear and tear unsuitable for the use for which it is intended, since proof of said defects or wear can be established by the tenant ,
  • In the event of breakage, the tenant agrees to return the damaged equipment and it must be recognizable and complete. The damage suffered by the equipment will be invoiced to the tenant according to the tariff in force annexed to this contract,
  • Theft and loss of material are not covered. In this case, the equipment will be invoiced to the tenant on the basis of its value, deducted from a percentage of obsolescence of 20% per year,
  • In the event of theft by the tenant, misappropriation or damage resulting from non-compliance with the rules of use or regulations in force, or the terms and conditions of this contract, the lessor is entitled to exercise a remedy for the all of the damage.
 
Article 7 Security deposit:
  • When the equipment is made available by the lessor, the lessee is asked to pay a deposit ($ 250.00 can on a valid credit card), the value of which is mentioned on the rental rates, this deposit is not cashed during the duration of the rental. When the equipment is returned, the deposit is returned to the tenant, less any damage provided for in Article 6.
 
Article 8 Return:
  • The return of the rented equipment will be done at the time specified in the contract, if the equipment is not returned within the dates and times stipulated in the contract, the lessor reserves the right to cash the amount of the deposit without prior notice.
 
Article 9 Eviction of the lessor:
  • The accessories delivered with the equipment must not be removed or modified by the tenant. The equipment cannot be transferred or given as a guarantee.  Article 10 Termination clause:
  • At the end of the rental period provided for in the contract and in the event of non-return or in the event of non-payment of a partial invoice, the tenant remains responsible for the equipment in his possession. Article 11 Jurisdiction:
